Judge Determines DOJ’s Position Is To Be Given “Limited Weight”


A Superior Court Judge has granted a Petition for Writ of Mandate in Dr. Simone Gold’s case against the California Medical Board (CMB). The Board had targeted Dr. Gold for exercising her free speech rights during the COVID-19 pandemic and attempted to revoke her physician’s license.


Dr. Gold is an emergency physician and attorney and the Founder and President of America’s Frontline Doctors (AFLDS). As the tyranny of the COVID-19 pandemic spread across our great Nation, Dr. Gold courageously led the charge against the Medical Industrial Complex and those pushing agendas at the expense of science. With AFLDS, Dr. Gold leads the nationwide movement to “Drain the Science Swamp.”


During the pandemic, Dr. Gold advocated for early life-saving medicinal treatments for COVID-19, including hydroxychloroquine and ivermectin, instead of “vaccination” or the combined treatments of remdesivir and ventilation. She also pushed back on mask and “vaccine” mandates and lockdowns—publicly denouncing medical censorship and tyranny and spreading the truth about COVID-19.


Dr. Gold and her legal team maintain that the CMB had no legal basis to target her. Rather, they allege that the CMB’s charges against her were in retaliation for her outspoken advocacy. Starting in December 2021, the CMB opened six “investigations” into Dr. Gold, accusing her of spreading “misinformation” and threatening her physician’s license.


In 2023, Dr. Gold sued the CMB in response to these illegal efforts to silence her. During a 3-day medical licensing hearing, the CMB pivoted from their original accusation of spreading COVID-19 “misinformation.” Instead, they alleged that Dr. Gold was devoid of professional ethics and judgment due to her misdemeanor presence at the U.S. Capitol on January 6, 2021—charging that her actions that day were “substantially related to the qualifications, functions, or duties of a physician.”


After the hearing, Administrative Law Judge (ALJ) Abraham Levy ruled that the CMB cannot revoke her license but concurred with the CMB’s J6 claims. The ALJ ordered that Dr. Gold be publicly reprimanded by the CMB and required to take a medical ethics course. Although retaining her license was a legal victory, Dr. Gold recognized that a physician of her stature and record should not be subjected to a reprimand or ethics course. With her legal team, Dr. Gold swiftly submitted a Writ of Mandate appeal to the Superior Court of California.


San Diego Superior Court Judge Michael T. Smyth vacated the CMB’s public reprimand and medical ethics course requirement, finding that the Board had failed to show with clear and convincing evidence that Dr. Gold’s conduct on J6 was “substantially related” to her role as a physician. Additionally, Judge Smyth awarded Dr. Gold financial relief for litigation costs.
